Terms of purchase and delivery

Ordering, delivery and purchase of goods on www.kuraslt.eu, the online electronic fuel delivery platform KURASLT, is subject to user registration.

The Buyer is a natural or legal person who has registered on the KURASLT.EU online platform and orders fuel for delivery.

‘Carrier’ means the operator of the KURASLT.EU online platform for fuel delivery who organises the logistics of the fuel ordered by the Customer

Fuel Seller – a fuel seller registered on the KURASLT.EU electronic online platform who has signed agreements with the Carrier for the use of the KURASLT.EU platform and delivery of fuel to Customers.

1. General Provisions

1.1 These Terms and Conditions of Delivery – Purchase of Goods (hereinafter referred to as the “Terms and Conditions”) set out the general terms and conditions of use of the KURASLT online platform www.kuraslt.eu. The Rules shall apply when the Customer selects, orders and purchases fuel offered in the KURASLT Shop or otherwise uses the services provided by the KURASLT Shop.

1.2 KURASLT is designed to organise the logistics of the delivery of fuel to the Buyers, and provides the Buyers with the opportunity to order and pay for the delivery of products on the Platform.

1.3 The KURASLT online fuel delivery platform organises the logistics of the delivery of fuel to the Customers, performs the related services and provides the Customer with the possibility to order and pay for the fuel. The delivery logistics for the Buyer shall be provided by Alvydas Virginis TŪB “Šoklio prekyba”, company address: Pramonės g. 8, 78149 Šiauliai, company code: 175895464, VAT payer code LT758954610.

1.4. Persons who have reached the age of majority are entitled to use and purchase from the KURASLT online shop in accordance with the procedure set out in the Rules.

1.5 Alvydas Virginis TŪB “Šoklio prekyba” shall enable the Customer to order and pay for fuel on the logistics platform. The money paid shall be transferred directly to the account of the Fuel Supplier, who shall then settle with the transporter on the basis of the statement (invoice) provided. The transporter invoices the Fuel Supplier for the delivery of the fuel and the use of the KURASLT platform. By placing an order, the Buyer unconditionally confirms that he/she is entitled to purchase on the KURASLT online shop.

1.6 Together with the Buyer’s order, these Terms and Conditions shall become a contract between the Buyer and the Fuel Seller and between the Fuel Seller and the Carrier and shall constitute a binding legal document for all parties. The Contract shall be deemed to have been concluded when the Buyer forms and submits an order for the Goods in KURASLT’s online shop, makes payment or chooses to pay for the Goods by collection in accordance with the procedure and within the time limits set out in the Terms and Conditions, and confirmation is sent by e-mail to the e-mail address specified by the Buyer that the Buyer’s order has been accepted.

1.7 Once the Buyer has ordered goods from the KURASLT online shop, the Buyer shall be deemed to have read and accepted the Terms and Conditions without exception.

1.8 The Carrier reserves the right to change, amend or supplement the Terms and Conditions. The Terms and Conditions in force at the time of placing an order shall apply to the Buyer’s shopping on the KURASLT Online Shop and the Buyer must therefore familiarise himself with the Terms and Conditions at the time of each shopping trip.

1.9 The Carrier shall not assume any risk or liability and shall be exempted from such liability without exception in the event that the Buyer has failed to read the Terms and Conditions in whole or in part, even if given the opportunity to do so.
1.10. The Carrier shall have the right to restrict the Buyer’s use of the services of the KURASLT online platform without notice if the Buyer uses the KURASLT online shop in violation of these Terms and Conditions, attempts to undermine KURASLT’s ordering, operational stability, security.

2. Processing of personal data

2.1 The Customer’s data shall be processed in accordance with the procedures set out in the Privacy Policy.

3. Delivery of ordered goods.

3.1 The Carrier shall deliver the Goods ordered by the Buyer to the address specified in the order at a time agreed with the Buyer.

4. Cancellation of order.

4.1 The Buyer has the right to cancel an order placed in the KURASLT online store by cancelling the order electronically or by calling the phone number +370 41 540017 before the moment of the start of the order.

4.2 The start of the order execution shall be deemed to be the moment when the ordered goods leave the warehouse of the Fuel Seller.

5. 5.1 The Carrier shall send and otherwise contact the Buyer at the email address or telephone number provided by the Buyer in the Order Form.

5.2 The Buyer shall send all notices and questions and otherwise contact the Carrier by e-mail (uzsakymai@kuraslt.eu) or telephone (+370 41 540017).

6. Final Provisions

6.1 These Rules are drawn up in accordance with the legislation of the Republic of Lithuania.

6.2 The law of the Republic of Lithuania shall apply to relations arising under these Rules.

6.3 In the event of damage, the party at fault shall indemnify the other party for direct damages in accordance with the procedure and on the grounds established by the laws of the Republic of Lithuania.

6.4 All disagreements arising out of the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.

6.5 Each User shall have the possibility to settle disputes with the Carrier electronically, without going to court. The Consumer shall first contact the Carrier in writing and within 14 days from the receipt of the claim, if the Carrier fails to respond to the Consumer’s claim or fails to satisfy the Consumer’s claim, the Consumer may apply to the out-of-court consumer disputes body, i.e., the State Consumer Rights Protection Service (Vilniaus g.25,
